Policies & Service Guidelines:
All services may be used for lawful purposes only. Transmission,
storage, or presentation of any information, data or material
in violation of any United States Federal, State or City law
is prohibited. Any violation of any Canadian or US laws is
prohibited. This includes, but is not limited to: copyrighted
material, material we judge to be threatening or obscene,
or material protected by trade secret and other statute. The
subscriber agrees to indemnify and hold us harmless from any
claims resulting from the use of the service which damages
the subscriber or any other party.

Note: Pornography and sex-related merchandising are prohibited
on all servers. This includes sites that may infer sexual content,
or link to adult content elsewhere. This is also true for sites
that promote any illegal activity or content that may be damaging
to our servers or any other server on the internet. Links to
such materials are also prohibited.
In addition any site selling or promoting Bulk email services
is not allowed
Examples of non-acceptable content or links:
Pirated software
Hackers programs or archives
Warez Sites
Irc Bots
Mp3
We will be the sole arbiter as to what constitutes a violation
of this provision.
Pharamond Services are Intended for the
End User Only.:
Customers cannot sublease, subhost, or give away control of
any portion of Pharamond Network's resources. For customers
who do wish to sublease web space, Pharamond Network offers
a very competitive resale program.
CGI Scripts:
Each account comes with its own cgi-bin. You are free to use
any CGI scripts you wish, however we reserve the right to
disable any CGI script that effects normal server operation.
Chat Rooms:
We do not allow clients to install their own chat rooms. These
tend to be large system hogs and we cannot allow it as an
account option. We do provide a choice of Java chatrooms for
a small extra charge that will more than fill your needs and
run without hindering the performance of the machine for others.
You are limited to one chatroom on your domain.
Background Running Programs:
We may allow programs to run continually in the background.
These are considered on a one to one basis and an extra charge
will be incured based on system resources used and operational
maintenance needed.
Email Spamming:
Spamming, or the sending of unsolicited and/or bulk email
to others on the Internet, from a Pharamond! server or from
an email address that is maintained by Pharamond! is strictly
prohibited. User will be charged a minimum $500.00 service
charge for each instance of verifiable spam that is reported
to Pharamond! and charges account termination.
None of the following is an acceptable use of Pharamond!
resources:
Sending Spam mentioning an email address for any domain hosted
by Pharamond!
Sending Spam mentioning a domain hosted by Pharamond!
Sending Spam mentioning an IP address hosted by Pharamond!
Posting references of adult sites to non-adult newsgroups.
Posting advertisements on IRC, ICQ, or any other public chat system.
Activities deemed to be unsolicited marketing efforts or otherwise harassing.
Other activities deemed to be unacceptable by Pharamond!
Pharamond! will be the sole arbiter as to what constitutes
a violation of these provisions.
As such, any violation will result in immediate deactivation
of services without refund.
Terms & Termination:
User has 30 days from date of account setup to be eligible for
a refund. All refunds requested with a "valid complaint"
will receive a refund of the charge periods. Specifically from
beginning of sign up to month's end and following charged months
if the beginning of the month and its charge have fallen in
the 30 day period. What constitutes "valid complaint"
shall be determined by Pharamond Enterprises Ltd. in its sole
and absolute discretion. No refund will be given on setup or
one time fee's for any reason.
By submitting a credit card on the order form, User agrees
to authorize all recurring charges to the account and any
other balances incurred due to overages of limits, additions
of extras to the account, service charges and/or any other
fees.
User will not receive a refund for any setup fees or any
fees other than the monthly recurring hosting fees. User will
not receive a refund for any other reason, including but not
limited to: late cancellation, unused time, slow connection
caused by client's ISP/network, client's ignorance, InterNIC
delays, already having logged in to his or her account many
times, having used the account for whatever reasons or purposes,
or account termination for violation of policies.
Pharamond reserves the right to terminate this agreement,
and to delete the Website from its hardware, immediately upon
the occurrence of any of the following events:
Non payment of any charges fue from User.
Breach of any term or condition of this agreement by User.
Commencement of any lawsuit or proceeding against User arising
from or relating to its use of the Website, whether or not
such suit names Provider as a party or seeks and recovery
from Pharamond Enterprises Ltd.
Server Abuse:
Any attempts to undermine or cause harm to a server is strictly
prohibited. And will be fined.
Refusal of Service:
We reserve the right to refuse or cancel service at our sole
discretion.
Deactivation:
If any terms or conditions are failed to be followed it will
result in grounds for immediate account deactivation.
Disclaimer:
Pharamond Enterprises Ltd. will not be responsible for any
damages your business may suffer. Pharamond Enterprises Ltd.
makes no warranties of any kind, expressed or implied for
services we provide. Pharamond Enterprises Ltd. disclaims
any warranty or merchantability or fitness for a particular
purpose. This includes loss of data resulting from delays,
nondeliveries, wrong delivery, and any and all service interruptions
caused by Pharamond Enterprises Ltd. and its employees. Pharamond
Enterprises Ltd. reserves the right to revise its policies
at any time without prior notification.
